By making a payment, the customer declares that he agrees to the general terms and conditions.

All conditions are listed on the website www.hundertmarkbeatz.de
In the case of a change of the here listed, all other points remain unaffected and are still valid.
The legal location of the company is Recklinghausen.
This written agreement and the general legal relationships are governed by German law.
If a beat contains samples, sample clearing must be done by the customer, not by Hundertmark Beatz (Nick de Lange/Dennis Schäfers/Julian Naaf/Jonas Jost).

The Licensee acknowledges that he is responsible for clearing all samples he wishes to use and that Licensor assumes no liability for misuse of sample material. The licensee understands and accepts that he has paid only for the production activity of the producer.

Licensor does not claim to have any rights to the Sample Material.
Under no circumstances is the customer entitled to resell the purchased beats in any form.
Rights acquired by the buyer are not transferable.
Even if exclusive rights to a beat are sold, Hundertmark Beatz (
Nick de Lange/Dennis Schäfers/Julian Naaf/Jonas Jost)

is allowed to use the beat for their own advertising purposes.
All sold beats will be marked as "SOLD" on our website or taken off the Store and any download and license options will be removed.
The customer can change the playing time of a beat as long as he owns a license for the beat and does not change the entire structure of the beat.
However, the buyer is not allowed to use melodies, instruments, sounds, drum arrangements, etc. of the original instrumental composition for other compositions.
After delivery of the instrument, Hundertmark Beatz is released from further obligations to the customer.
Hundertmark Beatz is not responsible for external websites that sell your beats. Violations will be prosecuted.

 
Rights of use

 
exclusive license
The acquisition of the exclusive rights grants the buyer full artistic and commercial rights to the purchased beats. There is no circulation or sales limit for exclusive rights.
The acquisition of exclusive rights includes a mixed, arranged and copy protection-free version of the instrument in WAV format ( 44.1 khz - 16 Bit), as well as the individual audio tracks and a contract with details of the usage rights.
Once the exclusive rights to a beat have been sold, we no longer offer it for sale/leasing.
Leasing rights that were previously sold are not affected.
It is possible that the beat was leased before it was sold exclusively.
The beat will be marked as "sold" or taken off the store and all possible download and purchase options will be removed.
The licenser expressly prohibits the resale or other distribution of his compositions.
The buyer is not entitled to sell, lend, rent or lease the beat. Melodies, instruments and drum programming may not be changed or removed.
The transfer of rights to another person (e.g. record label, other artists) is not permitted.
The licensee is aware that the licensor owns 100% of the copyrights and property rights of the original instrumental composition.
Licensees may not use the beats as background elements in TV, film & DVD / computer game projects.
This requires written consent and a separate license agreement.
The licensee must mention the producer by name on all releases (e.g. CD booklet, song description).
Example: "Beat prod. von Hundertmark Beatz" or "Music produced by Hundertmark Beatz". MP3 files must contain "prod. von Hundertmark Beatz" in the file name.

 
unlimited license
Also known as non-exclusive rights, leasing rights grant the buyer limited artistic and legal rights to a beat for a single commercial use on any sound carrier (e.g. album, EP or mixtape) with an unlimited edition/sale of copies.
The acquisition of leasing rights includes a mixed, arranged and copy protection-free version of the instrument in MP3 or WAV format and a contract with details of the rights of use.
A beat can be leased by several people at the same time until the exclusive rights have been sold. Once the exclusive rights to a beat have been sold, it is no longer available for leasing rights. Leasing rights that were previously sold are not affected.

Leasing rights do not make the customer the sole owner of a beat.
The buyer is not entitled to sell, lend, rent or lease the beat.
Melodies, instruments and drum programming may not be changed or removed.
The transfer of rights to another person (e.g. record label, other artists) is not permitted.

The licensee must mention the producer by name on all publications (e.g. CD Booklet, Youtube Videos, Myspace, Facebook etc.).

Example: "Beat prod. von Hundertmark Beatz" or "Music produced by Hundertmark Beatz". MP3 files must contain "prod. von Hundertmark Beatz" in the file name.

 

payment

Hundertmark Beatz accepts payments by Pay Pal, Western Union and bank transfer.

All payments must be made before delivery of the product.

This also means that the services or products of Hundertmark Beatz will only be delivered after receipt of payment.

 


right of revocation

Since our products offered online are digital content that is delivered to the buyer by download,

the right of revocation expires as soon as the files have been downloaded by the customer.

 

 

public performance

Commercial public performances (live gigs) are permitted for both license types.

 

 

shipment

Our products are not delivered via an automatic system - the delivery time can be up to 24 hours after receipt of payment.

All products are delivered digitally by e-mail via a download link from a data transmission service. Physical data carriers can be delivered at an extra charge.
